Edict of the President of the Republic of Belarus
of December 16, 2002 No. 609

[Amended as of April 12, 2018]

On the National Legal Internet Portal of the Republic of Belarus and on Introducing Changes and Additions into the Edict of the President of the Republic of Belarus of October 30, 1998 No.524

 

For the purposes of providing a constitutional right of citizens to receive full, valid and timely information, increasing the level of increase the level of legal awareness of the society, developing and improving of the single state system of legal information, I resolve:

1. To create the National Legal Internet Portal of the Republic of Belarus.

2. To approve the annexed Regulations on the National Legal Internet Portal of the Republic of Belarus.

3. To introduce the following changes and additions into the Edict of the President of the Republic of Belarus of October 30, 1998 No. 524 On Measures on Improvement of the State System of Legal Information:

3.1. to exclude part three of clause 3;

3.2. in the Regulations on the National Center of Legal Information of the Republic of Belarus approved by that Edict:

to lay down indent 16 of clause 6 in the following wording:

fulfills works on formation, conducting and ensuring the functioning of the National Legal Internet Portal of the Republic of Belarus;

in clause 8:

in part two words non-budget sourcesto replace with words sources not prohibited by legislation;

to exclude words and also forfrom part three, amending the part with the words and also for other purposes in accordance with legislation;

to lay down indent three of clause 13 in the following wording:

approves the list of staff members of the NCLI within the limits of general number of its employees, and also upon consent of the Administration of the President of the Republic of Belarus the staff number of regional centers of legal information and regulations on them;.

4. The National Center of Legal Information shall ensure the putting into operation of the National Legal Internet Portal of the Republic of Belarus before January 1, 2004.

5. The state bodies and other state organizations shall render practical assistance to the National Center of Legal Information at conducting works connected with creation and functioning of the National Legal Internet Portal of the Republic of Belarus.

6. This Edict enters into force from the day of its official publication.

REGULATIONS
on the National Legal Internet Portal of the Republic of Belarus

1. These Regulations determine legal and organizational basis for creation and functioning of the National Legal Internet Portal of the Republic of Belarus (hereinafter the National Legal Portal).

2. The National Legal Portal is a basic state information resource of the global computer network Internet in the sphere of law and legal informatization.

3. The purposes for creation and functioning of the National Legal Portal are:

concentration and systematization of information and knowledge on the issues of law and legal informatization;

official publication of legal acts included in the National Register of Legal Acts of the Republic of Belarus;

timely providing of citizens, state bodies and other organizations with full and accurate legal information and also with comments and other legal analytical materials;

ensuring an effective interaction of employees of state bodies and other organizations while using informational, organizational and technological capabilities of this portal;

increasing the quality of norm creating activity, effectiveness of work of state bodies and other organizations;

propaganda of legal knowledge and development of legal culture of citizens;

assisting to citizens in conducting scientific, educational and other kinds of activity;

intensifying the interstate exchange of legal information;

creating conditions for increasing an international authority of the Republic of Belarus and attracting investments to the national economy, developing entrepreneurial initiative, stimulating business activity of economic entities.

4. The National Center of Legal Information (hereinafter - NCLI) shall carry out formation, maintenance, and ensuring the functioning of the National Legal Portal, and also official publication of legal acts, including in the National Register of Legal Acts of the Republic of Belarus through their placement on the National Legal Portal in accordance with legislative acts.

5. Legal information is a base for information content of the National Legal Internet Portal. Also scientific and practical, educational, reference and other information is published in the given portal.

6. The the sources of such information are:

legal acts;

authors materials of scientists and other specialists;

mass media;

other sources.

7. Legal acts shall be presented to NCLI for inclusion in the National Register of Legal Acts and subsequent publication on the National Legal Portal in the order established by the legislative acts. Other information shall be presented for placement on the National Legal Portal by state bodies and state organizations on their initiative or at requests of NCLI, and also by citizens or created by NCLI itself.

8. Liability for violation of rights and legitimate interests of third persons is borne in accordance with legislation by a citizen or organization, which have submitted the information for placement on the National Legal Internet Portal.

9. Information containing data being state secrets of the Republic of Belarus or other information protected in accordance with legislation and/or information having relevant limitation stamps are not subject to placement on the National Legal Portal.

10. Information shall be placed with the consideration of the following requirements:

relevance, efficiency, accuracy and integrity;

clarity of structuring, distribution of data by thematic blocks;

multivariate presentation of information using different telecommunications facilities, technical software solutions and various levels of access thereto;

presentation of information in state languages of the Republic of Belarus and also in English.

12. Financing of works on creation and functioning of the National Legal Portal is carried out within the limits of the means of the republican budget allocated to NCLI, incomes from its economic activity and also other sources not prohibited by legislation.

14. For ensuring the the functioning of the National Legal Portal, NCLI may, if necessary, attract other organizations and respective specialists on a contractual basis.

15. Functioning of the National Legal Portal is covered in mass media and also in the global computer network Internet.
