Edict of the President of the Republic of Belarus
No.577 of September 14, 2006
[Amended as of June 3, 2016]

 

On Some Matters of Activity of Open Joint-stock Company “Belarusian Universal Commodity Exchange”

 

With the purposes of development of the organized wholesale market, perfection of the procedure of holding of the exchange tenders and increasing of effectiveness of activity of the open joint-stock company “Belarusian Universal Commodity Exchange”:

1. To establish that:

1.1. the list of goods, with which the legal persons and individual entrepreneurs shall be obliged to conclude transactions, including foreign trade transactions, at the exchange tenders of the Belarusian Universal Commodity Exchange, and conditions of conclusion of such transactions shall be determined by the Council of Ministers of the Republic of Belarus on the grounds of national interests unless otherwise determined by the President of the Republic of Belarus.

The State Customs Committee shall monthly submit to the Ministry of Antimonopoly Regulation and Trade the information on transferring the goods, specified in the list according to part one of this sub-clause, across the National Frontier of the Republic of Belarus;

1.2.[Excluded]

1.3. monetary funds from export of goods, transactions with which are effectuated at the exchange tenders, can be credited to the special account of the Belarusian Universal Commodity Exchange with the subsequent transfer on the accounts of exporters. Settlements under the foreign trade contracts, providing import of goods, transactions with which are effectuated at the exchange tenders, can be carried out from the special account of this exchange;

1.4. [Excluded]

1.5. the Ministry of Antimonopoly Regulation and Trade shall effectuate the organization and development of electronic trade (wholesale) in the Republic of Belarus, using the information systems and networks of the Belarusian Universal Commodity Exchange.

The Belarusian Universal Commodity Exchange may be organizer of electronic trading (wholesale) in the order determined by the Council of Ministers of the Republic of Belarus.

2. The Belarusian Universal Commodity Exchange shall be exempted from compulsory sale of foreign currency received on its accounts from participants of exchange trade and their clients as securing of performance of the obligation on the exchange transactions.

5. The Council of Ministers of the Republic of Belarus shall:

5.1. in coordination with the Department of Affairs of the President of the Republic of Belarus, Regional Executive Committees and Minsk City Executive Committee, in 2006-2007, in accordance with existing procedure, if necessary, submit to the President of the Republic of Belarus the proposals on transferring the premises, necessary for the further development of the Belarusian Universal Commodity Exchange and for creation of its branches, into the ownership or uncompensated use of this Commodity Exchange;

5.2. within three months:

approve the list of goods, with which the legal persons and individual entrepreneurs shall be obliged to conclude transactions at the exchange tenders of the Belarusian Universal Commodity Exchange, and to determine conditions of conclusion of such transactions;

develop and approve the program of development of the Belarusian Universal Commodity Exchange for 2007-2010;

provide bringing of acts of legislation in conformity with this Edict and take other measures for its implementation.

6. This Edict enters into force since the date of its official publication.
