Order of coming into force of the new Code of Administrative Offenses and Procedural and Executive Code of Administrative Offenses determined

The new Code of Administrative Offenses and Procedural and Executive Code of Administrative Offenses were officially published, the National Legal Internet Portal of the Republic of Belarus informs.

The main feature of the new codes is the priority of preventive measures over punishment. According to the Law of the Republic of Belarus of 6 January 2021 No. 93-Z, the new codes shall come into force from 1 March 2021.

According to Law No. 93-З from 1 March 2021 cases of administrative offenses that, according to the new Code of Administrative Offenses are not administrative offenses, as well as cases of administrative offenses for which the time limits for imposing administrative sanctions have expired must be terminated. Also unexecuted (in whole or in part) decisions on the imposition of administrative sanctions for the commission of acts that are not administrative offenses in accordance with the new Code of Administrative Offenses are not subject to execution.
