Edict of the President of the Republic of Belarus

No. 114 of March 20, 1996

[Amended as of June 15, 2009]


On Free Economic Zones on the Territory of the Republic of Belarus



With the aim to ensure favorable conditions for economic development of regions of the Republic of Belarus, mobilization of foreign investments, creation of new jobs, acceleration of scientific and technological progress, development of trade and economic cooperation with other states

I hereby decree:

1. [Excluded]

2. To establish the free economic zone "Brest" (hereinafter -- FEZ "Brest").

To establish the total area of the FEZ "Brest" equal to 7231.48 hectares according to the Appendix.

The FEZ "Brest" is a complex zone. The term of its functioning is 50 years (calculated from 23 August 1996).

The financing of the development of the FEZ "Brest", including industrial, engineering, transport, and other infrastructure, inclusive of the maintenance of the administration of the FEZ "Brest" and other expenses, specified by the legislation, for ensuring the functioning of the zone, is to be made at the expense of funds of the republic budget and the development fund of the FEZ "Brest".

The mentioned fund is to be formed at the expense of rent payments for land within the limits of the FEZ "Brest", proceeds received in accordance with the contracts about conditions of activity in the zone, and other proceeds in accordance with the legislation.

The specific sources of forming of that fund and directions of spending its means are to be determined by the Council of Ministers of the Republic of Belarus.

3. The Government of the Republic of Belarus shall, within two months:

3.1. approve:

Regulations on FEZ "Brest" with indication of the following: exact name of the zone; specific features of its legal status; terms of functioning of the zone; objectives and tasks to be implemented therein; a list, structure and jurisdiction of administrative and control bodies of the zone; ways of their interaction with other state bodies and economic entities operating in the FEZ;

Regulations on the Administration of the FEZ "Brest".

3.2. Together with respective local bodies of administration and self-administration operating on the territory of the FEZ "Brest", solve the issue of transferring under the authority of the Administration of this zone the objects being in the republic and municipal ownership in the order specified by the legislation.

4. To propose to the National Bank to establish its branches in the FEZ "Brest", if required, and to solve the issue of licensing foreign currency operations performed by banks (branches of banks) located on its territory.

5. The Ministry of Management of State Property and Privatization together with Administration of the FEZ "Brest" shall, within two months, approve a list of objects being in the state ownership and subject to top-priority privatization on the FEZ territory.

6. Local executive and administrative bodies operating on the territory of the FEZ "Brest" shall delegate to the Administration of the FEZ the powers specified by the present Edict, including the right to perform the state registration of economic entities, submit a statement of claim to the court for termination or cessation of economic entities-residents of the zone, as well as their representative offices in the FEZ in the case of violation of the legislation by them.

7. The present Edict enters in force from the date of its publication.




Appendix

to the Edict of the President

Boundaries of the Free Economic Zone "Brest"



The land plot No. 1 ("Kozlovichi" region) having the area of 5873 hectares is limited from the north and northeast by the lands of the transport Republic's Unitary Enterprise "Brest Branch of the Belarusian Railways", and the Republic's Unitary Enterprise "Belavtostrada" (road Е30/М1), from the southeast – by the lands of the Transport Republic's Unitary Enterprise "Brest Branch of the Belarusian Railways", and the City of Brest, from the southwest – by the State Border of the Republic of Belarus, from the northwest – by the lands of the Republic's Unitary Agricultural Enterprise "Selection and Hybrid Centre "Zapandy".

The land plot No. 2 ("Airport" region) having the area of 1207 hectares is limited from the northwest by the lands of the Republic's Unitary Enterprise "Belavtostrada" (road Е30/М1), from the east – by the lands of the Communal Unitary Agricultural Enterprise "Sovkhoz Brestskiy", from the south – by the lands of the Communal Unitary Agricultural Enterprise "Sovkhoz Brestskiy", and the Republic's Unitary Enterprise of Aeronavigation Servicing of Air Traffic "Belaeronavigatsia", from the west – by the lands of the Communal Unitary Agricultural Enterprise "Sovkhoz Brestskiy", and the Communal Unitary Agricultural Enterprise "Hothouse Combine "Berestie".

The land plot No. 3 (the lands of the Joint-Stock Companies "Brest Electromechanical Factory" (15.69 hectares), "Brest Radio Engineering Factory" (15.15 hectares) and "Brest Electric Bulb Factory" (22.4 hectares) having the area of 53.24 hectares is limited from the north by the lands of the Joint-Stock Company "Carpets of Brest", and the Brest Republic's Unitary Enterprise of Electric Power Industry "Brestenergo", from the east – by Soviet Constitution Street, from the southeast – by Moscovskaya Street, and from the west – by Pionerskaya Street.

The land plot No. 4 (the lands of the Republic's Unitary Enterprises "Tsvetotron Plant", the Research and Production Association "Integral" (41.83 hectares) and the "Brest Machine Building Factory" (26.76 hectares), having the area of 68.59 hectares is limited from the north by Suvorova Street, from the east – by Kariernaya Street, from the south – by the lands of the Garage-Construction Cooperative Societies Nos. 9 and 11, and from the west – by the lands of general use of the City of Brest.

The land plot No. 5 (the lands of the Open Joint-Stock Company "Brest Electromechanical Factory" (village of Ploska) having the area of 29.65 hectares from the north and east is bordered by the lands of the State Forestry Establishment "Brest Forestry", from the south and southwest – by the lands of the City of Brest, from the northwest – by the lands of the Road Design, Repair and Construction Unitary Communal Enterprise "Brest Regional Department of Local Highways" (road Cherni-Ploska).
