On Establishment of Free Economic Zones "Minsk" and "Gomel-Raton"

With the aim to attract national and foreign investments into creation and development of production facilities based on new and high technologies, to ensure favourable conditions for economic development of the regions of the Republic,

I decree:

1. To establish Free Economic Zones "Minsk" for the 30 years period and "Gomel-Raton" for the 50 years period.

To establish the total area of the Free Economic Zone "Minsk" equals to 1604.92 hectares within the boundaries according to Appendix 1, and the Free Economic Zone "Gomel-Raton" equals to 5302,7841 hectares within the boundaries according to Appendix 2.

2. To determine that:

2.1. Free Economic Zones "Minsk" and "Gomel-Raton" shall be zones of a complex nature;

2.2. financing of the development of the Free Economic Zones "Minsk" and "Gomel-Raton", including idustrial, engineering, transport and other infrastructure along with maintenance of the administrations of the Free Economic Zones "Minsk" and "Gomel-Raton" and other expenses stipulated by the legislations for ensuring functioning of the said zones, is carried out at the account of the means of the republic budget and development funds of the Free Economic Zones "Minsk" and "Gomel-Raton";

2.3. development funds of the Free Economic Zones "Minsk" and "Gomel-Raton"are formed at the account of lease payments for land and property, which are in operative administration of the administrations of those zones, as well as from receipts in accordance with the contracts on activity condtions of economic entities on the territory of the zones.

Specific sources of forming development funds of the Free Economic Zones "Minsk" and "Gomel-Raton" and directions of their spending are determined by the Council of Ministers of the Republic of Belarus.

3. The Council of Ministers of the Republic of Belarus shall:

3.1. approve, within a two months' period, the following regulations:

- about the Free Economic Zones "Minsk" and "Gomel-Raton" which is reflect the peculiarities of its legal regime, the list, the structure and the competence of the management and control bodies of the zones, the methods of its interaction with other state bodies and the economic entities operating in these zones;

- about Administration of the Free Economic Zones "Minsk" and "Gomel-Raton";

3.2. solve, in the established order, the problem of transfer, in the first half of 1998, into operative command of the administrations of the Free Economic Zones "Minsk" and "Gomel-Raton" the property which is in the republican and communal ownership.

4. The National Bank in cooperation with the Ministry of Finance and upon agreement with the administrations of the Free Economic Zones "Minsk" and "Gomel-Raton" drafts, within a three months' period and submit, in the established order, into the Council of Ministers of the Republic of Belarus the procedure of providing foreign investors with financial guarantees of export of the incomes obtained on the territories of the above zones, and the order of executing currency operations on these territories.

5. The Ministry of Finance, in the 1st quarter of 1998, determines the mechanism of formation of the budgets of the Free Economic Zones "Minsk" and "Gomel-Raton".

6. The State Customs Committee, within a two months' period since the approval date of the Regulations on the Free Economic Zones "Minsk" and "Gomel-Raton", establishes the order of customs clearance of goods imported to the territories of the above zones, and exported from these territories.

7. The local executive and administrative bodies who are operating on the territories of the Free Economic Zones "Minsk" and "Gomel-Raton", in the 1st quarter of 1998, delegates to the administrations of these zones the authorities to withdraw and lease to the residents of these zones land estates located within the boundaries of these zones.

8. The present Edict enters into force from the date of its publication.

Boundaries of the Free Economic Zone "Minsk"

The land plot No. 1 having area of 1110 hectares is located in the southeast part of Minsk and includes 4 separate sectors:

- Sector 1 having the area of 290 hectares is bordered in the north by Partizanskiy Avenue, in the east – by the lands of the Transport Republic's Unitary Enterprise "Minsk Branch of the Belarusian Railways", in the south – by the lands of the City of Minsk, and in the west – by the lands of the Republic's Unitary Enterprise of Highways "Minskavtodor-Centre" (Minsk Ringway);

- Sector 2 having the area of 298 hectares is bordered in the north by the lands of the City of Minsk, in the east – by the lands of the Transport Republic's Unitary Enterprise "Minsk Branch of the Belarusian Railways", in the south – by the lands of the Minsk Regional Unitary Enterprise "DRSU No. 735" (highway Novy Dvor – Matsevichi), in the west – by the lands of the Novy Dvor Rural Soviet of the Minsk District, of the Communal Unitary Agricultural Enterprise "State Farm-Agrarian Company 'Rassvet'" of the Minsk District, and the lands of the City of Minsk;

- Sector 3 having the area of 372 hectares is bordered in the north by the lands of the City of Minsk, in the northeast – by Selitskogo Street, in the east – by the lands of the Communal Unitary Agricultural Enterprise "State Farm-Agrarian Company 'Rassvet'" of the Minsk District, in the south – by the lands of the Minsk Regional Unitary Enterprise "DRSU No. 735" (highway Novy Dvor – Matsevichi), in the west – by the lands of the Transport Republic's Unitary Enterprise "Minsk Branch of the Belarusian Railways";

- Sector 4 having the area of 150 hectares is bordered in the north by the lands of the Republic's Unitary Enterprise of Highways "Minskavtodor-Centre" (highway Minsk - Mogilyov), in the east and south – by the lands of the Communal Unitary Agricultural Enterprise "State Farm-Agrarian Company 'Rassvet'" of the Minsk District, in the west – by the lands of the City of Minsk and the Communal Unitary Agricultural Enterprise "State Farm-Agrarian Company 'Rassvet'" of the Minsk District.

The land plot No. 2 having total area of 192.16 hectares includes 2 isolated sectors:

- Sector 1 having the area of 69.52 hectares is bordered in the northeast by the lands of the Republic's Unitary Enterprise "Minsk Tractor Works" (auxiliary farm), in the southeast – by the lands of the Minsk Regional Unitary Enterprise "DRSU No. 735", in the southwest – by the lands of the Republic's Unitary Enterprise of Highways "Minskavtodor-Centre" (highway Minsk – Mogilyov), the Republic's Unitary Enterprise "Minsk Tractor Works" (auxiliary farm), in the northwest – by the lands of the Production Communal Affiliated Unitary Enterprise "Minsk Forest and Park Enterprise";

- Sector 2 having the area of 122.64 hectares is bordered in the northeast, the east, and the southeast by the lands of the Republic's Unitary Enterprise of Highways "Minskavtodor-Centre" (highway Minsk – Mogilyov, road interchange of highways Minsk-Mogilyov and Brest-border of the Russian Federation, highway Brest-border fo the Russian Federation), in the southwest – by the lands of the Trade and Production Affiliated Unitary Enterprise "Minsk Forest and Park Husbandry", in the west and the northwest – by the lands of the Trade and Production Republic's Unitary Enterprise "DORORS" of the Belarusian Railways.

The land plot No. 3 having the area of 30 hectares is located in the vicinity of the settlement of "Sosny" and is bordered in the north, east, south, and west by the lands of the Production Communal Affiliated Unitary Enterprise "Minsk Forest and Park Husbandry".

The land plot No. 4 having the area of 252.81 hectares is located in the vicinity of the Republic's Unitary Enterprise "National Airport Minsk" and comprises 2 sectors:

- Sector 1 having the area of 54.04 hectares is bordered in the north, east, south and west by the lands of the Republic's Unitary Enterprise "National Airport Minsk";

- Sector 2 having the area of 198.77 hectares is bordered in the north by the lands of the Republic's State Association "Belpochta", the Republic's Unitary Enterprise "National Airport Minsk", in the east – by the lands of the State Forestry Enterprise "Smolevichi Forestry Enterprise", the Foreign Private Unitary Production and Trade Enterprise "Stotz Agro-Service" of the Company "Stotz Agro-Service GmbH and Co, KG", in the south – by the lands of the Republic's Unitary Enterprise "National Airport Minsk", the State Forestry Enterprise "Smolevichi Forestry Enterprise", in the west – by the lands of the Republic's Unitary Enterprises "National Airport Minsk" and "National Airline "Belavia".

The land plot No. 5 having the area of 19.95 hectares is located in the southwest part of Minsk, bordered in the nord east by the lands of Minsk City Executive Committee, in the south east -- by the lands of Minsk City Executive Committee, Building and Installation Republic's Unitary Enterprise "Radiostroi"; in the south west -- by the lands of Minsk City Executive Committee; in the west -- by the lands of Scientific and Production Republic's Unitary Enterprise "Dialek", Limited Liability Company "Scald"; in the nord west -- by the lands of Minsk City Executive Committee.

Boundaries of the Free Economic Zone "Gomel-Raton"

The land plot No. 1 having the area of 3152 hectares is located in the northern part of the City of Gomel, and is bordered in the north by the lands of the Collective Farm (Agricultural Production Cooperative) "Lopatinskiy" of the Gomel District, and the Communal Agricultural Unitary Enterprise "Khalch" of the Vetkovskiy District, in the east – by the lands of the Pokolyubichi Village Soviet of the Gomel District, and by the Krupskaya Street, in the south – by Malaichuk, Sovietskaya, Fedyuninskogo Streets, and Inzhenerny Pereulok, in the west – by the lands of the City of Gomel, the Private Industrial Unitary Enterprise "Zapad-Trnasnefteproduct" (former Mozyr Department of Oil Pipelines), the Collective Farm (Agricultural Production Cooperative) "Eryominskiy" of the Gomel District, the Open Joint-Stock Company "Gomel Raiagroservice", the Transport Republic's Unitary Enterprise "Gomel Branch of the Belarusian Railways".

The land plot No. 2 having the area of 442 hectares is located in the western part of the City of Gomel and includes five isolated sectors:

- Sector 1 having the area of 60 hectares is bordered in the north by the lands of Collective Farm (Agricultural Production Cooperative) "Pobeda" of the Gomel District, in the east – by the lands of the Transport Republic's Unitary Enterprise "Gomel Branch of the Belarusian Railways" (railway run Gomel-Northern), the Open Joint-Stock Company "Belstromremont Trust", the Communal Affiliated Construction Unitary Enterprise "Gomel DSPMK-51", in the south – by the lands of the City of Gomel, the Republic's Construction Unitary Enterprise "SP", in the west – by Dalnaya Street, and the lands of the Mobile Mechanized Fleet No. 21 of the "Sovkhozstroi" Trust;

- Sector 2 having the area of 84 hectares is bordered in the north by the lands of the Open Joint-Stock Company "Gomeltorgavtotrans", the Communal Agricultural Unitary Enterprise "Semena Trav", the Communal Unitary Enterprise "Gomel Oblagropromenergo", the Open Joint-Stock Company "Gomel Raiagropromenergo", in the east – by the lands of the Private Industrial Unitary Enterprise "Gomel Factory of Trading Equipment", and the Industrial-Trading Republic's Unitary Enterprise "Gompromtara", in the south – by the Transport Proezd, and Barykina Street, in the west – by Industrial Proezd;

- Sector 3 having the area of 65 hectares is bordered in the north by the lands of the Republic's Unitary Enterprise " Gomel "Tsentrolit" Foundry, in the east – by Borissenko Street, in the south and the west – by the lands of the City of Gomel;

- Sector 4 having the area of 70 hectares is bordered in the north, east, south and west by the lands of the State Forestry Establishment "Gomel Forestry";

- Sector 5 having the area of 163 hectares is bordered in the north by the lands of the Communal Agricultural Unitary Enterprise "Brilyovo" of the Gomel District, and the Communal Design-Repair-Construction Unitary Enterprise "Gomelobldorstroi" (highway Gomel-Zhlobin), in the east – by the lands of the Collective Farm (Agricultural Production Cooperative) "Pobeda" of the Gomel District, in the south – by the lands of the Open Joint-Stock Company "Gomel Chemical Plant", in the west – by the lands of the Republic's Unitary Enterprise of Highways "Magistralavtodor" (Northern detour of the City of Gomel).

The land plot No. 3 having the area of 128 hectares is located in the southern part of the City of Gomel, and is bordered in the north by the lands of the City of Gomel, in the east – by the lands of the Ministry of Defence (Military Settlement No. 2), in the south – by Zhemchuzhnaya and Ilyicha Streets, and the lands of the State Forestry Establishment "Korenevskaya Experimental Forestry Base of the Institute of Forest of the National Academy of Sciences of Belarus", in the west – by Ilyicha and Tekhnicheskaya Streets, and the Sixth and Eighth Pereuloks Ilyicha.

The land plot No. 4 having the area of 624,3918 hectares - the territory of the industrial zone "Mikhalki" is located in the city of Mozyr of the Gomel region:

bordered in the north by lands of the Mikhalki forestry of the State Trial Forestry Establishment "Mozyrski opytnyi leskhoz" (from the eastern corner of the planning quarter No. 77), in the south-east, by lands of the subsidiary agricultural husbandry of the Republic Unitary Enterprise "Kombinat on Production of Medical and Alcohol-containing Products 'Ethanol'", of the Open Joint-Stock Company "Mozyr Oil Refinery", the roadway access lane to the station Barborov of the Republic's Unitary Enterprise of Highways "Gomelavtodor";

in the east bordered by lands of the Open Joint-Stock Company "Mozyr Oil Refinery", the roadway access lane to the station Barborov of the Republic's Unitary Enterprise of Highways "Gomelavtodor";

in the south to the north-west direction bordered by the roadway access lane to the station Barborov of the Republic's Unitary Enterprise of Highways "Gomelavtodor", the oil pipeline "Druzhba" of the Republic's Unitary Enterprise "Gomeltransneft Druzhba", lands of the Mikhalki forestry of the State Trial Forestry Establishment "Mozyrski opytnyi leskhoz" (the planning quarter No. 77);

in the west bordered by the roadway access lane to the station Barborov of the Republic's Unitary Enterprise of Highways "Gomelavtodor", in the north-east direction, by the oil pipeline "Druzhba" of the Republic's Unitary Enterprise "Gomeltransneft Druzhba", lands of the Mikhalki forestry of the State Trial Forestry Establishment "Mozyrski opytnyi leskhoz" (the planning quarter No. 77).

The land plot No. 5 having the area of 217,4565 hectares is located in the city of Rechitsa of the Gomel region:

in the north bordered by lands of the Republic's Unitary Enterprise of Highways "Gomelavtodor", the State Trial Forestry Establishment "Rechitskiy opytnyi leskhoz", common-use lands of the city of Rechitsa;

in the east bordered by lands of the Republic's Unitary Enterprise of Highways "Gomelavtodor", the Republic's Unitary Enterprise 'Production Association "Belorusneft"', common-use lands of the city of Rechitsa, the Communal Agricultural Unitary Enterprise "Sovkhoz Istok", the State Trial Forestry Establishment "Rechitskiy opytnyi leskhoz";

in the west bordered by lands of the Communal Agricultural Unitary Enterprise "Sovkhoz Istok", the Republic's Unitary Enterprise of Highways "Gomelavtodor", the State Trial Forestry Establishment "Rechitskiy opytnyi leskhoz";

in the south bordered by lands of lands of the Transport Republic's Unitary Enterprise "Gomel Branch of the Belarusian Railways", the Republic's Unitary Enterprise of Highways "Gomelavtodor", the Communal Agricultural Unitary Enterprise "Sovkhoz Istok".

The land plot No. 6 having the area of 322,68 hectares - the territory of the Opens Joint-Stock Company "Gomel Chemical Plant" is located in the city of Gomel, in the south bordered by lands of the city of Gomel, the the State Forestry Establishment "Gomelski leskhoz", by the highway M-8 of the Republic's Unitary Enterprise of Highways "Gomelavtodor", in the west, by the highway M-8 of the Republic's Unitary Enterprise of Highways "Gomelavtodor", in the north, by lands of the Communal Agricultural Unitary Enterprise "Brilyovo", the Open Joint-Stock Company "Gomelthekhmontazh, the Open Joint-Stock Company "Spetsavtomatika", the affiliate of the Open Joint-Stock Company "Khimremont" --the Design-Repair-Construction Unitary Directorate No. 4, the Gomel City Executive Committee, detour highway of the City of Gomel of the Communal Design-Repair-Construction Unitary Enterprise "Gomelobldorstroi", in the east, by lands of the Communal Design-Repair-Construction Unitary Enterprise "Gomelobldorstroi".

The land plot No. 7 having the area of 389,3058 hectares is located in the village of Ziabrovka of the Gomel district of the Gomel region:

in the north bordered by lands of the State Forestry Establishment "Korenevskaya Experimental Forestry Base of the Institute of Forest of the National Academy of Sciences of Belarus";

in the east bordered by lands of the Communal Agricultural Unitary Enterprise "Experimental Base Gomelskaia", the State Forestry Establishment "Korenevskaya Experimental Forestry Base of the Institute of Forest of the National Academy of Sciences of Belarus", in the north-east, by the spur track of the railroad of the Transport Republic's Unitary Enterprise "Gomel Branch of the Belarusian Railways", by lands of the Transport Republic's Unitary Enterprise "Gomel Branch of the Belarusian Railways", in the south-east, by lands of the State Forestry Establishment "Korenevskaya Experimental Forestry Base of the Institute of Forest of the National Academy of Sciences of Belarus" and the Communal Agricultural Unitary Enterprise "Experimental Base Gomelskaia";

in the south bordered by land of the village of Pribytki of the Pribytki Rural Committee, the Communal Agricultural Unitary Enterprise "Experimental Base Gomelskaia" and the State Forestry Establishment "Korenevskaya Experimental Forestry Base of the Institute of Forest of the National Academy of Sciences of Belarus", by the highway H-4106 of the Communal Design-Repair-Construction Unitary Enterprise "Gomelobldorstroi";

in the west bordered by lands of the the State Forestry Establishment "Korenevskaya Experimental Forestry Base of the Institute of Forest of the National Academy of Sciences of Belarus".

The land plot No.8 having the area of 18,61- the territory of the Republic's Unitary Enterprise "Gomel Carriage-Repair Works after M.I.Kalinin" of the Belarusian Railways is located in the city of Gomel, in the north and the east bordered by land of the Transport Republic's Unitary Enterprise "Gomel Branch of the Belarusian Railways", in the south, by land of the Gomel City Executive Committee, in the west, by lands of the individual entrepreneur Asimov I.A., the Education Institution "Belarus State University of Transport", the Garage-Building Consumer Cooperative No. 29 of the Soviet district of the city of Gomel, Gomel Regional Organization of the Public Association "Belarus Society of Disabled Persons", by streets Bannaia Alleia and Moskovskaia, ba lands of citizens, by streets Swobody and Khimakova, by lands of the Garage-Building Consumer Cooperative No. 22 of the Soviet district of the city of Gomel and the Transport Republic's Unitary Enterprise "Gomel Branch of the Belarusian Railways", the street of Demian Bedny, by lands of the Limited Liability Company "Inizial-Complect".

The land plot No. 9 having the area of 8,34 hectares - the territory of the Joint Enterprise of the Open Joint-Stock Company "Gomel Electromechanical Works" and the Joint Limited Liability Company "Belvinil" is located in the city of Gomel, in the west and the north bordered by lands of the Transport Republic's Unitary Enterprise "Gomel Branch of the Belarusian Railways", in the east by Avenue Kosmonauts, by lands of the Joint Enterprise of the Open Joint-Stock Company "Gomel Electromechanical Works", in the south by streets Kropotkina and Polesskaia.
