Belarus suggests developing common BRICS agreement on providing legal aid

BelTA) – Chairman of the Supreme Court of Belarus Andrei Shved has suggested developing an international agreement on legal assistance for all the BRICS member states and partner countries. Andrei Shved put forward the initiative at a BRICS forum of presidents of supreme courts in New Delhi, India, the press service of Belarus’ Supreme Court told BelTA.
The chairman of the Supreme Court delivered a report on the enforcement of rulings of foreign courts in Belarus. It was noted that in conditions of active international economic cooperation, intensification of migration processes, and the growth of direct transboundary contacts between citizens, the matter of providing proper judicial protection of the rights and legitimate interests of individuals and commercial entities is topical.
“One of the criteria for the effectiveness of such judicial protection is the ability to enforce court rulings in foreign countries,” Andrei Shved stressed.
Bilateral and multilateral agreements regulating the recognition and enforcement of foreign court rulings are in force in relations between Belarus and a number of BRICS member states and partner countries.
Thus, agreements on cooperation in legal affairs apply in relations with Russia, China, Iran, Egypt, Vietnam, Kazakhstan, Uzbekistan, and Cuba. The existence of international treaties allows Belarusian courts to fairly effectively consider petitions for the recognition and enforcement of foreign court rulings.
At the same time, Andrei Shved drew attention to the fact that in practice a number of systemic problems remain. The main difficulties are associated with non-compliance with the special procedure for notifying parties, the absence of clear requirements for summons service documents, and differences in the list of judicial acts subject to execution.
Taking this into account, to improve mechanisms for recognizing and enforcing foreign court rulings, key proposals of the head of the Belarusian delegation were an initiative to develop an international agreement on legal assistance for all the BRICS member states and partner countries, clarification of existing bilateral agreements in terms of detailing the notification procedures and the list of necessary documents, digitization of interaction – transition to electronic document management between courts and strengthening direct contacts between supreme courts to bring the routines closer to each other and share the best practices.
The chairman of the Supreme Court stressed that the matter of international legal cooperation is an important one. Judicial systems play a separate role in it. Professional interaction between courts of the countries is an essential element of general stability, legality, and law and order.
He added that as an effective platform for open dialogue, the BRICS forum of presidents of supreme courts contributes to establishing mutual understanding in matters of administering justice, strengthening trust and cooperation, exchanging experience, and working out joint solutions to modern challenges.
The forum is taking place on 4–5 September. Taking part in the event are heads of supreme courts of BRICS member states and partner countries.
