Recognition, enforcement of CIS courts’ rulings analyzed for first time in CIS

MINSK ( BelTA) – The practice of recognizing and enforcing court rulings of the Commonwealth of Independent States countries has been analyzed for the first time in the CIS, BelTA learned from Chairman of the Supreme Court of Belarus Andrei Shved during the second session of the Council of Supreme Court Chairpersons of the CIS member states in Minsk.

Andrei Shved thanked all members of the council, the heads of the highest judicial bodies of the CIS countries, for the extensive and substantial work done. “The information you have submitted has been summarized, comprehensively studied, and included in the consolidated review of judicial practice in the consideration of cases (applications) on the recognition and enforcement of rulings of foreign courts of the CIS member states,” he said.

The chairman of the Supreme Court noted that such work had been carried out for the first time within the framework of the council. “We have tried to take a comprehensive look at how the provisions of international treaties on the recognition and enforcement of court rulings are applied in practice in the CIS states, what approaches are already common, in what matters differences remain, and, most importantly, what problems require our joint discussion and resolution,” Andrei Shved added. He expressed the opinion that the consideration of this matter at the council is timely and practically significant.

The recognition and enforcement of foreign court rulings is one of the most important elements of international legal aid, he pointed out. Real judicial protection of citizens and organizations beyond the borders of the state, in which the ruling was made, largely depends on how efficiently this institution operates.
“In other words, a court ruling has to retain its practical significance even when the need for its enforcement goes beyond national borders,” the chairman of the Supreme Court emphasized.

The summary of judicial practice has shown that the CIS countries cooperate quite actively in this sphere. The necessary international legal framework has taken shape and considerable experience of interaction between courts and other competent bodies has been accumulated.

On the whole he emphasized the value of the joint work done. The first analysis of the practice of recognizing and enforcing foreign court rulings prepared within the framework of the council made it possible to see the matters that require further joint reflection. The chairman of the Supreme Court spoke in favor of continuing such analytical work.

In December 2024 Belarus assumed the chairmanship of the Council of Supreme Court Chairpersons of the CIS member states.

The headline topic on the agenda of today’s session is related to the recognition and enforcement of rulings of foreign courts of the CIS member states. The topic is relevant and significant for each of the CIS states. It is directly related to the enforcement of court rulings of national courts and, accordingly, to the protection of both citizens of the countries and commercial entities.
