On the National Legal Internet Portal of the Republic of Belarus and on Introducing Alterations and Amendment to the Edict of the President of the Republic of Belarus

Edict of the President of the Republic of Belarus of December 16, 2002 No.609

[Amended as of January 8, 2009]

For the purposes to provide a constitutional right of citizens to receive full, valid and timely information, to increase the level of legal information distribution to the society, development and improvement of a single state system of legal information, I resolve:

1. To create the National Legal Internet Portal of the Republic of Belarus.

2. To approve the enclosed Regulation on the National Legal Internet Portal of the Republic of Belarus.

3. To introduce to the Edict of the President of the Republic of Belarus dated of October 30, 1998 No. 524 “On Measures of Improvement of the State System of Legal Information” the following alterations and amendment:

3.1. to exclude part three point 3;

3.2. in the Regulation on the National Center of Legal Information of the Republic of Belarus approved by this Edict:

paragraph sixteenth point 6 to set forth in the following edition:

“fulfills works on formation, conducting and providing of functioning of the National Legal Internet Portal of the Republic of Belarus”;

in point 8:

in part two words “non-budget sources” to replace with words “sources not prohibited by legislation”;

out of part three to exclude words “and also for” amending the part with the words “and also for other purposes in accordance with legislation”;

paragraph three point 13 to set forth in the following edition:

“approves the list of staff members of the NCLI within the limits of general number of employees, and also under agreement with the Administration of the President of the Republic of Belarus – the staff number of regional centers of legal information and regulations on them;”.

4. The National Center of Legal Information shall provide putting into operation of the National Legal Internet Portal of the Republic of Belarus before January 1, 2004.

5. The state bodies and other state organizations shall render practical assistance to the National Center of Legal Information at conducting works connected with creation and functioning of the National Legal Internet Portal of the Republic of Belarus.

6. The present Edict enters into force from the day of its official publication.

REGULATION

On the National Legal Internet Portal of the Republic of Belarus

1. The present Regulation determines legal and organizational basis for creation and functioning of the National Legal Internet Portal of the Republic of Belarus (further – the National Legal Portal).

2. The National Legal Portal is a basic state information resource of global computer network Internet in the sphere of law and legal informatization.

3. Purposes for creation and functioning of the National Legal Portal are the following:

  • concentration and systematization of information and knowledge on law and legal informatization issues;
  • timely providing of citizens, state bodies and other organizations with full and valid legal information and also with comments and other legal analytical materials;
  • providing an effective interaction of employees of state bodies and other organizations while using informational, organizational and technological capabilities of this portal;
  • increasing the quality of legislative activity, effectiveness of work of state bodies and other organizations;
  • propaganda of legal knowledge and development of legal culture of citizens;
  • assisting to citizens in conducting scientific, educational and other kinds of activity;
  • intensification of inter-state legal information exchange;
  • creating conditions for increasing an international authority of the Republic of Belarus and attracting investments to the national economy.

4. Formation, conducting and providing of functioning of the National Legal Internet Portal is carried out by the National Center of Legal Information (further – the NCLI).

5. Legal information is a base for information content of the National Legal Internet Portal. Also scientific and practical, educational, reference and other information in the sphere of law and legal informatization is published in the given portal.

6. The following are the sources of such information:

  • official documents*;
  • author’s materials of scientists and other specialists;
  • mass media;
  • other sources containing information in the sphere of law and legal informatization.

7. Information for publishing in the National Legal Portal is given by state bodies and other organizations at their initiative or at the requests of the NCLI and also by citizens, or is created directly by the NCLI.

8. Liability for violation of rights and legal interests of the third persons is borne in accordance with legislation by a citizen or organization having submitted the information for publishing in the National Legal Internet Portal.

9. Information containing data being state secrets of the Republic of Belarus or other information protected in accordance with legislation and (or) information having relevant limitation stamps is not subject to publishing in the National Legal Portal.

10. Information is published with the consideration of the following requirements:

  • urgency, efficiency, validity and integrity;
  • clarity of structure and distribution of data according to a subject;
  • multi-variance of submitting information with the usage of various telecommunication means, technical software solutions and different levels for its access;
  • submitting information in state languages of the Republic of Belarus and also in English.

11. Excluded.

12. Financing of works on creation and functioning of the National Legal Portal is carried out within the limits of the assets of the republican budget apportioned to the NCLI, incomes from its economic activity and also other sources not prohibited by legislation.

13. Types of information services rendered via National Legal Portal and terms of their rendering are determined by the NCLI under the agreement with the Administration of the President of the Republic of Belarus.

14. For providing of functioning of the National Legal Portal the NCLI may, if necessary, attract other organizations and relevant specialists on contractual basis.

15. Functioning of the National Legal Portal is covered in mass media and also in global computer network Internet.
